Welcome to Hayi!

 

Hayi is a free, private social network for neighbourhoods in Dubai. Hayi (Arabic for Neighbourhood) provides neighbours with an exclusive platform to connect, share information and befriend those in close proximity. 

 

Dubai is known as one of the most family-friendly locations in the world, offering a plethora of safe and secure compounds, luxurious properties and endless nearby attractions. The only thing missing is a sense of community! Hayi aims to bring those around us together, to help contribute to Dubai’s mission of becoming the Happiest City in the World.

Hayi can be used to:

• Find people with common interests 

• Organize a carpool to work or school

• Get recommendations on home maintenance providers

• Hire a local babysitter 

• Find local business

• Connect with local service providers 

• Discuss any happenings within the neighbourhood

 

Neighbours privacy is our primary concern. Users are required to verify their address through one-time location sharing or via alternate methods. User’s details are stored according to their neighbourhood and not by their villa/street number.  

 

These Terms are legally binding and they govern your use of Hayi and the other products, features, apps, services, technologies and software that we offer, except where we expressly state that separate terms apply. The services are provided to you by Hayi. 

 

This agreement (“Agreement”) describes your rights and responsibilities related to your use of Hayi website mobile apps, and services as a registered Hayi user and what you can expect from us.

By entering into this agreement you expressly acknowledge that you have read and understand all the terms of this agreement. We don't charge you to use Hayi or the other services covered by these Terms. 

 

A user may only have one account registered and must be used by that specific person and not any other person.  Verification for logging in with another device will be required from the user.

When you register for Hayi you must use your real name, not a pseudonym.

 

You may not use our Services if:

• You are a resident of the United Arab Emirates and are under 13 years old, (or do not meet applicable age requirements to use social media services in the United Arab Emirates).

• You have been convicted as a sex offender or share a household with one;

• Your account was previously disabled by us for violations of our terms or policies; 

• You are prohibited from receiving our Services or platform under applicable United Arab Emirates law.

 

If you believe that a user in Hayi does not meet the above mentioned eligibility requirements, you may report your concerns and the specific account via our Help Centre. 

 

Hayi reserves the right to refuse registration to any person or household and to suspend, delete or deactivate your account or limit your privileges at any time, without liability to you. Furthermore

Hayi can remove or restrict access to content that is in violation of any provisions in the terms.

 

Submitting inaccurate registration information, registering if you know you don’t meet our eligibility requirements, or otherwise providing false registration information is a violation of this Agreement and could constitute a crime. 

 

Hayi is created for the meaningful interaction with users in the United Arab Emirates and must do so in a way that upholds the integrity, respect and morals and values of Hayi and fellow users this also includes our community guidelines. Therefore users must not engage in conduct that:

• Breaches these terms, our privacy policy and the abovementioned community guidelines that apply to your use of Hayi.

• That is unlawful, misleading, discriminatory or fraudulent in terms of United Arabs Emirates Cyber Laws or any other laws.

• That infringes or violates someone else's rights, including their intellectual property rights. Furthermore a user must not provide any content that you don’t have the right to publish, or that is defamatory, infringing, illegal or otherwise tortious.

• A user may not upload viruses or malicious code, or do anything that could disable, overburden or impair the proper working or appearance of our Services. Furthermore a user may not access or collect data using automated means or attempt to access data that you do not have permission to access.

 

A user retains all ownership rights to the text, photos, video, responses and other content you submit to Hayi. You give us permission, in the form of a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license, to use, copy, and publish your content based on your settings and the selections you make when posting and as otherwise described in our Privacy Policy. This means, for example, that if you share a photo on Hayi, you give us permission to store, copy and share it with others (again, consistent with your settings) such as service providers that support our service.  

 

The abovementioned licence will end when your content is deleted from our systems. You can delete content individually or all at once by deleting your account. 

 

When you delete content, it's no longer visible to other users; however, it may continue to exist elsewhere on our systems where:

 

Immediate deletion is not possible due to technical limitations (in which case, your content will be deleted within a maximum of 90 days from when you delete it; your content has been used by others in accordance with this licence and they have not deleted it (in which case, this licence will continue to apply until that content is deleted); or 

Where immediate deletion would restrict our ability to:

 

Investigate or identify illegal activity or breaches of our Terms and Policies (for example, to identify or investigate misuse of our Products or systems); comply with a legal obligation, such as the preservation of evidence; or comply with a request of a judicial or administrative authority, law enforcement or a government agency; in which case, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis).

 

In each of the above cases, this licence will continue until the content has been fully deleted.

 

You will automatically receive notifications from Hayi about posts from neighbours, and users in the area, and from public services. You may also opt in to various interests for which you will then receive notifications. You can change your preferences about receiving messages from public services, businesses, or other organisations, and customise your default and opt-in neighbourhood notification settings.

 

By accepting the Agreement you grant Hayi permission to use your name, profile picture and information about your actions with ads and sponsored content within the area: You give us permission to use your name and profile picture and information about actions that you have taken on Hayi next to or in connection with ads, offers and other sponsored content that we display across our services, without any compensation to you.

Our Privacy Policy explains how we handle users’ personal information.  By using Hayi, you acknowledge that you have read the Privacy Policy. Hayi users are expected to respect the privacy of other users within the United Arab Emirates and therefore they may not:

• Share with a third party or post a neighbour’s information (e.g. name, address, phone number, email address) without their permission;

• Repost information or content posted on Hayi without the posting member’s permission;

• Repost (either on or outside of Hayi) the content of another member’s private message without the author’s permission; or

• Gather, collect or aggregate information from Hayi, either manually or by using automation (such as through scripts, robots, crawlers, spiders or similar technologies) for use outside of Hayi or attempt to access information you do not have permission to access.

We may need to update these Terms from time to time to accurately reflect our services. We will only make changes if the provisions are no longer appropriate or if they are incomplete, and only if the changes are reasonable and take due account of your interests.

 

We will notify you (for example, by email or through our services) at least 30 days before we make changes to these Terms and give you an opportunity to review them before they go into effect, unless changes are required by law. Once any updated terms are in effect, you will be bound by them if you continue to use Hayi.

 

We hope that you will continue using Hayi, however if you do not agree to our updated terms and no longer want to be part of Hayi, you can delete your account at any time.

 

We work hard to provide the best services we can and to specify clear guidelines for everyone who uses them. Our services, however, are provided as they are, and we make no guarantees that they will always be safe, secure or error-free, or that they will function without disruptions, delays or imperfections. 

 

To the extent permitted by law, we also disclaim all warranties, whether express or implied, including the implied warranties or merchantability, fitness for a particular purpose, title and non-infringement. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content that they share (including offensive, inappropriate, obscene, unlawful and other objectionable content).

 

We cannot predict when issues may arise with our services. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstances will we be liable to you for any lost profits, revenues, information or data, or consequential, special, indirect, exemplary, punitive or incidental damages arising out of or related to these terms or the Hayi services, even if we have been advised of the possibility of such damages.

 

If you download and install the  app, we give you a limited, revocable, non-transferable license to use it only to access and use Hayi on your own behalf through your iOS or Android product; additional terms may apply from the site you download it from (Apple App Store or Google Play store) or the manufacturers of your device or software.
